Personal Data Protection

We fully respect every person's right to privacy and personal data protection. Maximum security in processing your personal data, as well as its protection, is a matter of course in our company, and something you can rely on.

To ensure the protection of every piece of your personal data that we come into contact with in the course of our work, we have adopted technical, organizational, and personnel measures in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter also referred to as "GDPR"), and also to ensure that all our measures comply with Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts, as amended (hereinafter referred to as the "Personal Data Protection Act").

It is important to us that everyone who uses our company's services is informed about the reasons and methods of processing personal data, the ways in which personal data is handled, as well as the rights that the law grants them in connection with the processing of personal data. In this document, we provide you with all the necessary information regarding the above-mentioned areas.

In connection with the measures adopted for the protection of personal data, we comply with strict rules that determine which employee of ARTRA s.r.o. has access to personal data, as well as which of your personal data they are authorized to process.

 

1. Who is the controller of your personal data?
The controller of personal data is the company ARTRA s.r.o., with its registered office at Víťazná 394/44, 958 04 Partizánske, Slovakia, Company ID: 31594689, VAT ID: SK2020467823, registered in the Commercial Register of the District Court Trenčín, section Sro, insert no. 2448/R

2. What personal data do we process?
In our company, we work only with those personal data that enable us to provide services within the scope of our activities, i.e. to process our customers' orders in terms of administration and delivery, so that we comply with our legal obligations and also to protect our legitimate interests.

 

3. For what purposes do we process personal data?
We process the personal data of our clients for the purpose of providing goods and services within the scope of our activities. We characterize the individual purposes as follows:

Processing of data based on contract performance
We process personal data for the purposes of concluding a contract between the customer, as our client, and us, as the supplier, when using our services. In such a case, personal data is processed only to the extent necessary for the conclusion and performance of the relevant contract. This includes in particular the performance of the subject matter of the contract, customer support, contract management, and record-keeping of participants.

For this purpose, the provision of personal data by the customer is entirely voluntary, but is necessary for the successful conclusion of the contract and its subsequent performance. Without this data, we would not be able to conclude a contract with the client and fulfill the obligations and rights arising from it.

Processing of data for marketing purposes
We also process the personal data of our clients for marketing purposes, provided we have obtained their consent for this purpose. Marketing relates in particular to the following activities:

Offering products and services of ARTRA s.r.o. Based on your consent, we may send you offers electronically, primarily in the form of emails, or in the form of SMS messages and social media messages.

Sending informational emails containing commercial offers, articles, and information from the activities related to the scope of business of ARTRA s.r.o.

The consent provided for marketing purposes is voluntary. However, it is necessary in order for us to be able to send you offers of services from ARTRA s.r.o. Without your consent, we cannot provide individual offers of goods and services. You may withdraw your consent at any time by email at: artra@artra.sk

4. Use of cookies
Cookies are small text files that are stored on your computer or mobile device when you visit our website. Among other things (depending on the type of cookies), this allows our website to remember your recent activities and user preferences, e.g. login credentials, language, font size, or display settings of our website for a certain period of time, so that these preferences do not need to be set again on your next visit.

When you visit our website, some of your data is automatically processed, e.g. information about the internet browser and operating system used, the domain of the website from which you access our site, the number of visits, the average time spent browsing specific pages, etc. This data is stored for the purpose of monitoring the attractiveness of our website, as well as for improving its functional and content settings. This also constitutes our legitimate interest, which is the legal basis for processing your data. The aforementioned data is processed using cookies, IP addresses, and other technical tools that enable us to evaluate which parts of our website are popular, what visitors to our website view, and how much time they spend on those pages. Cookies consist of information that the web server sends and stores in your internet browser. This information is then sent back to the web server each time you visit our website. This allows the web server to identify and track your internet browser. The cookies used by the Controller are classified as so-called technical cookies, which are necessary for monitoring data transfers in order to adapt our website to the needs of visitors.

When visiting our website, you have the option to accept the use of cookies by clicking the consent button. If you do not confirm your consent or if you disable the use of cookies, you will have the same access to our website as if you had given your consent, resulting in less precise data being collected for our purposes, i.e. for the purpose of website optimization. We also note that even if you accept the use of cookies, you can remove them from your internet browser at any time. In such a case, upon your next visit to our website, you will again be asked to express the aforementioned consent.

We also analyze the use of our website through the Google Analytics service. Google Analytics collects information about the use of our portal using cookies. 5. How long do we store your personal data?
Personal data necessary for the conclusion and performance of a contract is processed for the duration of the contractual relationship and for the following 10 years after the termination of the contractual relationship, when required by generally binding legal regulations, in particular the VAT Act in connection with the archiving of tax documents containing your data.

Personal data obtained on the basis of consent will be processed until the consent is withdrawn by the customer, i.e. for the duration of the customer's interest in fulfilling the purpose of their processing, e.g. for the duration of the customer's interest in receiving a newsletter.

After the expiry of the stated period, personal data will be deleted, with the exception of data that, in accordance with generally binding legal regulations, we may continue to process in the interest of defending our legal claims.

6. Where do we obtain personal data from?
We obtain personal data:

- Directly from the client upon conclusion, during the course of, and in the performance of the contract.
- Directly from the client by granting consent to the sending of informational emails.
- From other persons to whom the client has given consent.


7. How can you withdraw your consent to the processing of personal data for marketing purposes?
Consent to the processing of personal data for marketing purposes is based on voluntariness, and for this reason the client may withdraw it at any time. If the client does not wish to receive offers from us, they can inform us of this by email at artra@artra.sk

What should the withdrawal of consent contain?
Who is submitting the withdrawal. Please provide your first name, last name, and email address.

State that you do not wish us to continue processing your personal data for marketing purposes. You may withdraw your consent in general (it will apply to all marketing activities), or specify which marketing activities the withdrawal applies to.

8. What rights does the client have in connection with the processing of personal data?
We place great emphasis on respecting the rights of our customers. In connection with the processing of your personal data, you are entitled to exercise the following rights:

Provision of information on the processing of personal data
This concerns primarily the identity and contact details of the controller, the purposes of processing and categories of data, information about the recipient or categories of recipients of personal data, information about the transfer of personal data to third countries, the retention period of personal data, authorized controllers, an enumeration of your rights, the possibility of contacting the Office for Personal Data Protection, the source of the personal data being processed, information on whether and how automated decision-making and profiling takes place.

Right of access to data
The customer has the right to confirmation as to whether or not their personal data is being processed. In the event that personal data is being processed, they are entitled to access information about the purposes of processing, the categories of data concerned, the recipients, and the retention period of personal data. The customer also has the right to information about their rights, as well as the right to lodge a complaint with the Office for Personal Data Protection. The client is also entitled to access information about the source of personal data, whether automated decision-making and profiling takes place, as well as information and guarantees in the case of the transfer of personal data to a third country or international organization. The customer has the right to be provided with a copy of the personal data being processed.

Right to rectification
In the event that your personal data has changed, as a result of which ARTRA s.r.o. would be processing outdated or inaccurate personal data, you may inform us and we will correct your recorded personal data.

Right to erasure
We are obliged, in certain cases stipulated by law, to erase personal data upon the instruction of the customer. The exercise of the right to erasure obliges us to assess whether the conditions required by law for erasure are met, since in certain cases prescribed by law we are obliged to retain and archive personal data for the period stipulated by law, even if the client requests that the data be deleted.

Right to restriction of data processing
You may exercise the right to restriction of data processing if you wish us to process the personal data you have provided exclusively for necessary legal reasons, or if you request that we block your personal data.

Right to data portability
If the customer requests that we provide their personal data to another company, they may ask us to transfer their personal data in an appropriate format. We will do so provided that no legal or other significant obstacles prevent us from doing so.

Right to object to automated individual decision-making
In the event that the customer believes or discovers that their personal data is being processed in a manner that infringes upon their private and personal life, or that we are processing their personal data in violation of applicable legislation, we ask that they contact us with a request for an explanation or for the removal of the unsatisfactory situation. An objection may also be raised directly against automated decision-making.

Right to contact the Office for Personal Data Protection
The client may address any complaint or grievance in connection with the processing of personal data to the Office for Personal Data Protection of the Slovak Republic.

Exercising rights
You may exercise your right to the protection of personal data provided to ARTRA s.r.o. at the email address gdpr@artra.sk. We provide our response free of charge. In the event that the request is disproportionate or recurs repeatedly, we reserve the right to charge an adequate fee that reflects the administrative costs of providing the information.

9. Who has access to your personal data?
Consent to the processing of personal data is given by the client to ARTRA s.r.o. The company has access to personal data as the controller. Access to personal data is primarily granted to employees of ARTRA s.r.o.; personal data may also be made available to contractual processors, such as programmers, e-shop administrators, delivery companies, and accounting services.

Contractual processors are companies that manage our system and ensure the operation of the company and the functioning of its individual parts. ARTRA s.r.o. has concluded a data processing agreement with these processors. The processors are also bound by compliance with personal data protection rules, including confidentiality, in order to guarantee the highest level of legal protection that meets the requirements of the applicable legislation in the territory of the Slovak Republic.
